The Supreme Court is progressing toward overturning Roe v. Wade. The Texas heartbeat anti-abortion bill (Senate Bill 8; “S.B. 8”) will probably be deemed
unconstitutional; however, it will be because of a technical reason, but this Court clearly wants to overturn Roe v. Wade. Several of the members were
appointed by President Donald Trump during his four year administration with this specific goal in mind.
Your task in this paper is to discover and articulate how we got here. It isn’t a discussion about the morality of abortion. It is a constitutional fact. Please do
not include your personal opinion in any aspect of this assignment. It isn’t about our opinions, it is about constitutional law and the Supreme Court’s opinion.
(And be sure to note that in this context “opinion” refers to the decision of the Supreme Court in a case, and that decision becomes the law of the land.)
Women have the right to control their reproductive futures. Abortion exists. That will not change even if it is criminalized. One in three American women have
had an abortion. The morality of the issue is beyond the scope of the paper or even the course. We are here to understand the law, the politics, the
government response on state and federal levels.
