Week 8: Final Assignment
Instructions
In lieu of a final exam this week, you will have research, analyze and write a legal memorandum for your hypothetical lawyer boss, as well as prepare draft correspondence on your boss’ behalf to a new client. Use the following fact pattern as the basis for both documents:
Ricky is a full-time grad student taking Legal Studies courses. He hopes to someday fulfill his dream of becoming the lead paralegal manager at Howe, Prack, Tiss & Law, the world’s largest international law firm that happens to be headquartered in his home state of Montana.
Tired of looking at snow, Ricky decided to enjoy Spring Break in Florida. Ricky flew to Ft. Lauderdale, Florida for a week with all of the other Spring Breakers who have converged on the city that week.
Ricky thoroughly enjoyed several great days in Ft. Lauderdale. While he was there, Ricky decided to buy a used car and drive back to Montana. He bought a 1974 Fordham Pintobean because it was painted neon green; that would make it easier for him to find his car in the Montana snow after he got home.
All good things must come to an end, and the same was true for Ricky’s vacation. When that time came, Ricky filled up the gas tank on his new old car. Then he started driving north.
A few hours later, Ricky ran into some traffic gridlock on the interstate near Valdosta, Georgia. After rounding a curve, he had to come to an immediate stop. Unfortunately for Ricky, the driver (Lucy) of the car behind him did not stop in time to avoid a collision.
As soon as Lucy’s car struck Ricky’s Pintobean, a fireball consumed both cars. Even though Ricky had already applied his brakes due to the slowed traffic, the force of the hit from Lucy’s car caused Ricky’s car to strike Ethel’s pickup truck, which was in front. Lucy died as a result of the accident, while Ricky sustained serious burns and multiple broken bones. Ethel suffered whiplash and a nervous breakdown because of the accident.
Several months later, a process server knocked on Ricky’s door at his Montana home, and handed him an envelope that contained all of the necessary paperwork from Ethel, who was suing him based on that dreadful accident. Ricky has now come to your attorney’s small law firm (Mee, Mihself and Eye); he wants advice on what to do now.
Mr. Mee has accepted Ricky as a new client. While he focuses on defending Ricky against Ethel’s lawsuit, Mr. Mee has asked you to help in preparing the case. In particular, he wants you to draft a legal office memorandum about a single issue: whether Florida (the state where Ricky bought his car) has a lemon law that could possibly be used in Ricky’s case. If so, then he wants you to analyze that law relative to the above- described fact pattern. In addition, Mr. Mee also wants you to write the first draft of client letter that he wants to send to Ricky along with a copy of your legal office memorandum.
As a single Microsoft Word (.doc or .docx) document submission, please turn in: (a) your legal memorandum (no more than five pages in length), (b) correspondence (no more than two pages in length), and (c) proof that you used either Nexis Uni or FastCase as you researched. Use the formats and strategies that you have learned in this course. Be sure that you apply proper Bluebook citations, as appropriate.
